NOTE: The federal government’s “gainful employment” rules (effective July 1, 2011) require disclosure of specific information when advertising certain programs (such as the occupation that the program prepares students to enter, the on-time graduation rate for students completing the program, the tuition and fees charged, and the placement rate and median loan debt for students completing the program. See 34 C.F.R. sec. 668.6(b)).

The disclosure provisions in 34 C.F.R. sec. 668.6(b) were upheld in a June 30, 2012, ruling by the U.S. District Court for the District of Columbia.  Schools are still required to comply with the disclosure requirements of 34 C.F.R. sec. 668.6(b) pending further judicial, administrative, or Congressional action. Other provisions of the “gainful employment” rules were vacated and remanded to the U.S. Department of Education.
